Exchange Policy

EA CARTS LLC, TERMS OF SALE & CUSTOM BUILD POLICY

  1. GENERAL CONDITIONS: By placing an order or submitting a deposit with EA Carts LLC ("Company"), the Purchaser ("Customer") agrees to be bound by these Terms. This agreement supersedes all prior verbal or written communications.

  1. CUSTOM BUILDS & DEPOSITS

  • Custom Definition: Any order requiring specific color selections, seat materials, performance upgrades, or specialty accessories is classified as a "Custom Build."

  • Deposits: A non-refundable deposit of 50% to 100% (as specified on your invoice) is required to begin procurement and production.

  • Finality: Work begins immediately upon receipt of the deposit. Because materials are ordered specifically for your build, all custom deposits are strictly non-refundable, subject to the qualifying-defect resolution described in Section 3.

  1. RETURN & EXCHANGE POLICY

  • Material Defects: A customer must report a material operational or safety defect within two (2) calendar days of delivery or before driving the cart 15 miles, whichever occurs first. EA Carts must be given a reasonable opportunity to inspect and repair the issue. If the material issue cannot reasonably be corrected, the cart may be returned without a restocking fee. Minor noises, squeaks, adjustments, cosmetic concerns, and normal wear do not qualify.

  • All Other Returns: Outside the material-defect situation above, any return requires EA Carts' approval and is subject to a $2,500 restocking fee plus original and return transportation costs.

  • Custom Builds: ALL CUSTOM BUILDS ARE FINAL SALE. No returns or exchanges will be accepted for vehicles built to customer specifications, subject to the qualifying-defect resolution above.

  • Used Inventory: All used equipment is sold "AS-IS, WHERE-IS" with no warranty expressed or implied by EA Carts, unless a separate written warranty is expressly included in the sale documents.

  • Financed Golf Carts: For financed golf carts, refunds or credits will be disbursed directly to the financing company, fulfilling the obligations of the original financing contract.

  • For exchanges, execution of a new financing contract is required.

  • Return Process: For approved returns, the purchaser is responsible for returning the golf cart to EA Carts LLC in Carmel, IN during business hours (9 AM-4 PM). The purchaser will bear all costs associated with returning the golf cart. The golf cart will be inspected and tested upon receipt by EA Carts LLC before any credits or refunds are issued.

  1. DELIVERY & "TIME NOT OF THE ESSENCE"

  • Estimated Timelines: For fully custom builds, lead times typically range from 3 to 6 months. All delivery dates provided are estimates only.

  • Liability for Delays: EA Carts shall not be liable for any loss, damage, or "loss of use" claims resulting from delays caused by supply chain disruptions, shipping carrier availability, or acts of God. Customer acknowledges that "time is not of the essence" regarding delivery.

  1. SHIPPING & RISK OF LOSS

  • EA-Arranged Delivery: Where delivery is arranged by EA Carts, EA Carts remains responsible for the vehicle during transit. Risk of loss or damage transfers only when the cart is delivered to the agreed destination and accepted by the Customer or an authorized recipient.

  • Customer Pickup: For customer pickup, risk of loss transfers when the Customer takes possession at EA Carts' facility.

  • Delivery Inspection: Customer should inspect the vehicle upon arrival and note any visible transit damage on the Bill of Lading (BOL) before signing. Concealed transit damage must be reported to EA Carts in writing, with photographs, within forty-eight (48) hours after delivery.

  • Delivery Pricing: Delivery is quoted with your order based on the destination and delivery requirements. Any residential, special-access, or unloading costs are included in the quote before purchase. Indiana deliveries are free; other zones are quoted from EA Carts' standard delivery zone pricing.

  1. LIMITATION OF LIABILITY: EA Carts' total liability for any claim shall not exceed the purchase price of the equipment. In no event shall the Company be liable for consequential, indirect, or punitive damages, including but not limited to personal injury, death, or property damage resulting from the misuse or unauthorized modification of the vehicle.
