Exchange Policy

EA CARTS LLC – TERMS OF SALE & CUSTOM BUILD POLICY

  1. GENERAL CONDITIONS: By placing an order or submitting a deposit with EA Carts LLC ("Company"), the Purchaser ("Customer") agrees to be bound by these Terms. This agreement supersedes all prior verbal or written communications.

  1. CUSTOM BUILDS & DEPOSITS

  • Custom Definition: Any order requiring specific color selections, seat materials, performance upgrades, or specialty accessories is classified as a "Custom Build."

  • Deposits: A non-refundable deposit of 50% to 100% (as specified on your invoice) is required to begin procurement and production.

  • Finality: Work begins immediately upon receipt of the deposit. Because materials are ordered specifically for your build, all custom deposits are strictly non-refundable.

  1. RETURN & EXCHANGE POLICY

  • Standard Inventory: New, non-customized carts may be returned within 2 days or 10 miles (whichever comes first) subject to a $2,500 restocking fee and deduction of all original shipping costs.

  • Custom Builds: ALL CUSTOM BUILDS ARE FINAL SALE. No returns or exchanges will be accepted for vehicles built to customer specifications.

  • Used Inventory: All used equipment is sold "AS-IS, WHERE-IS" with no warranty expressed or implied by EA Carts.

  • Financed Golf Carts: For financed golf carts, refunds or credits will be disbursed directly to the financing company, fulfilling the obligations of the original financing contract.

  • For exchanges, execution of a new financing contract is required.

  • Return Process: The purchaser is responsible for returning the golf cart to EA Carts LLC’s in Carmel, IN during business hours (9 AM-4 PM). The purchaser will bear all costs associated with returning the golf cart. The golf cart will be inspected and tested upon receipt by EA Carts LLC before any credits or refunds are issued.

  1. DELIVERY & "TIME NOT OF THE ESSENCE"

  • Estimated Timelines: For fully custom builds, lead times typically range from 3 to 6 months. All delivery dates provided are estimates only.

  • Liability for Delays: EA Carts shall not be liable for any loss, damage, or "loss of use" claims resulting from delays caused by supply chain disruptions, shipping carrier availability, or acts of God. Customer acknowledges that "time is not of the essence" regarding delivery.

  1. SHIPPING & RISK OF LOSS (FOB ORIGIN)

  • Transfer of Risk: Title to the vehicle and the risk of loss or damage passes to the Customer the moment the vehicle is loaded onto a transport carrier at our facility (FOB Origin).

  • Delivery Inspection: Customer is responsible for inspecting the vehicle upon arrival. Any transit damage must be noted on the Bill of Lading (BOL) with the carrier. EA Carts is not responsible for damage occurring during third-party transit.

  1. LIMITATION OF LIABILITY: EA Carts' total liability for any claim shall not exceed the purchase price of the equipment. In no event shall the Company be liable for consequential, indirect, or punitive damages, including but not limited to personal injury, death, or property damage resulting from the misuse or unauthorized modification of the vehicle.
